Ever since the first tenant signed a lease on a commercial property, there has been the potential for conflict between landlord and tenant. The landlord is usually seeking to maximise his income from a property investment, whilst the tenant wishes to contain his outgoings. Conflict can arise not only over the rent to be paid, but also about repairs and alterations. Schedules of Dilapidations and the continuing liability for default under a lease which has been assigned can come as a nasty shock to leaseholders. Often landlords are only seeking what is justly due to them, but lack of understanding when taking a lease can cause considerable problems at a later date. Identification of the true condition of a commercial property before signing a lease can be reflected in of a Schedule of Condition, limiting responsibility for repairs on a building which is in poor condition.
